Protection and fulfillment of the rights of victims of criminal acts have been recognized
as an integral part of the criminal justice system, even though the protection in the Criminal
Procedure Code protects the human rights of perpetrators of criminal acts more than the
rights/interests of victims of criminal acts. The application of the Restorative Justice concept in
settling criminal cases with adult perpetrators in the criminal justice system in Indonesia, so far
has been carried out at the investigative level (Polri) through Republic of Indonesia National
Police Regulation Number 08 of 2021, at the Prosecution level (Attorney) through Prosecutor's
Regulation Number 15 of 2020 as well as at the judicial level (Supreme Court) through the
Decree of the Director General of the General Court of the Supreme Court of the Republic of
Indonesia Number: 1691/DJU/SK/PS.00/12/2020, even though the policies and regulations
made and issued are not uniform or similar regarding the criteria of a criminal case that can be
resolved through restorative justice and its implementation.
